Bill description: This legislation increases regulation of driving instruction and training businesses.

Does it give government any new, additional, or expanded power to prohibit, restrict, or regulate activities in the free market?

Currently, every company is required to provide a Certificate of Occupancy. This bill stipulates only a business “that offers classroom instruction in a physical classroom location” must provide a copy of their certificate of occupancy with its application. Adding this language prevents the licensing board from rejecting applications for an increasing number of businesses that offer all of their instruction online. (+1)

This bill also places the responsibility of maintaining the proper licensing of instructors  on the business. Businesses failing to do this risk losing their license and could be fined up to $1,000.(-1)
